The Akkermansia Company US, Inc. (“TAC US,” “we,” “us,” or “our”) operates shopMETAbiotics.com and markets and sells products under the METAbiotics The Akkermansia Company brand (“METAbiotics”). The website, online store and related products, content, features, tools and services that link to this Privacy Policy are collectively referred to as the “Services.” Our online store is powered by Shopify, which enables us to provide the Services.

This Privacy Policy explains how TAC US collects, uses, discloses and otherwise processes personal information when you visit or use the Services, create an account, make a purchase, enroll in a subscription, complete a survey or quiz, submit a review, communicate with us, or otherwise interact with the Services. It also explains the privacy rights and choices that may be available to you.

This Privacy Policy applies to consumers in the United States. It does not apply to information processed in an employment or business-to-business capacity where a different notice applies. If there is a conflict between our Terms of Service and this Privacy Policy concerning personal information, this Privacy Policy controls.

Inferences

Predicted preferences, interests, likely product interests or other inferences drawn from transactions, usage, survey responses or interactions.

Sources of Personal Information

  • Directly from you, including when you purchase a product, create an account, enroll in a subscription, contact support, submit a review, complete a quiz or survey, enter a promotion or otherwise provide information.
  • Automatically from your browser or device through cookies, pixels, software development kits, local storage, web beacons and similar technologies.
  • From Shopify and our service providers, including payment, fulfillment, subscription, analytics, advertising, email, SMS, review, fraud-prevention and customer-support providers.
  • From marketing and advertising partners and from publicly available sources, as permitted by law.

How We Use Personal Information

Provide and administer the Services. Process transactions; fulfill and deliver orders; manage accounts, subscriptions, returns and customer support; enable reviews; remember preferences; and provide requested quizzes, surveys, product education or recommendations.

Personalize and improve. Understand how the Services are used; analyze performance; conduct research; develop and improve products, content and customer experiences; and tailor content and recommendations.

Marketing and advertising. Send promotional communications by email, text message or postal mail where permitted; measure campaigns; build audiences; and display or help others display advertising based on activity over time and across websites or services.

Security and fraud prevention. Authenticate accounts, secure transactions, detect and investigate suspected fraud or misuse, protect users and our business, and maintain service integrity.

Legal and business purposes. Comply with law and legal process, enforce our terms, protect rights and safety, maintain records, resolve disputes and support corporate transactions.

Where required, we rely on your consent for particular processing. You may withdraw consent as described at the point of collection or by contacting us, subject to legal limitations.

Cookies, Analytics and Advertising Technologies

We and our providers use cookies, pixels, tags, local storage and similar technologies to operate and secure the Services, remember settings, understand website use, measure communications and advertising, create advertising audiences, detect fraud and support advertising. Some technologies are necessary for the Services to function; others are used for analytics, communications or advertising.

These technologies and services include Shopify and its Audiences and Network Intelligence features; Meta Pixel; Google Analytics; Google Ads; Klaviyo for email and text-message communications; Bazaar voice for product reviews; and Loop for subscriptions. These providers may collect or receive identifiers, device information, usage information, commercial information, contact information or transaction information as appropriate to the service they provide.

Depending on the technology and applicable law, disclosure of identifiers, device information, usage information or commercial information to advertising partners may be considered a “sale,” “sharing,” or processing for targeted advertising, even when no money is exchanged. Browser settings may block certain cookies, but doing so may affect functionality. In jurisdictions where our Shopify privacy controls are presented, the banner offers options to accept, decline or manage preferences. Where an ongoing privacy-preference control is available, you may use it to change your choices later.

How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described in this Policy:

Shopify and commerce providers. Shopify hosts the store and provides commerce services, including Shopify Audiences and Network Intelligence. We also use payment, fraud-prevention, order-management, fulfillment, shipping and returns providers, and Loop to administer subscriptions.

Operational service providers. Providers supporting hosting, cloud storage, IT, security, customer support, surveys, research and professional services. We use Bazaarvoice to administer product reviews and Klaviyo to support email and text-message communications.

Analytics, marketing and advertising partners. We use Google Analytics to analyze website activity; Google Ads and Meta Pixel to measure campaigns, create audiences and support advertising; and Klaviyo to measure and manage communications.

Affiliates and corporate group. Our parent, subsidiaries and affiliates for internal administration, support and the purposes described in this Policy.

At your direction or with consent. Recipients you request or authorize, including social platforms, referral partners or other integrations.

Legal and transaction recipients. Government authorities, courts, advisers and counterparties where required by law, to protect rights or safety, enforce agreements, investigate misuse, or evaluate or complete a merger, financing, restructuring, sale or similar transaction.

We do not sell personal information for money. As explained above, certain advertising disclosures may nevertheless be defined as a “sale” or “sharing” under state privacy laws. We do not knowingly sell or share personal information of individuals under 16.

We do not sell consumer health data. We will not share consumer health data except as described in our Consumer Health Data Privacy Policy and with any consent required by law.

Relationship with Shopify

Shopify collects and processes information about access to and use of the Services to provide its platform and related features. Information submitted to the Services may be transmitted to Shopify and its service providers in the United States or other countries. Certain Shopify enhanced services may combine information from interactions with our store, other merchants and Shopify. For those activities, Shopify may independently determine how it processes information. Your Privacy Rights and Choices

Depending on your state of residence and subject to legal exceptions, you may have the right to: confirm whether we process your personal information; access or obtain a copy; correct inaccuracies; delete information; obtain portable data; opt out of sale, sharing or targeted advertising; opt out of certain profiling; limit certain uses or disclosures of sensitive personal information; withdraw consent; and appeal a decision concerning a privacy request. You also have the right not to receive discriminatory treatment for exercising applicable rights.

To submit a privacy request, email support@metabiotics.com. We may verify your identity before completing a request. An authorized agent may submit a request where permitted, but we may require proof of authorization and direct identity confirmation. If we deny a request, you may appeal by replying to our decision or emailing support@metabiotics.com with “Privacy Appeal” in the subject line.

Global Privacy Control and Do Not Track

Some browsers offer “Do Not Track” signals. Because there is no generally accepted standard for these signals, we do not currently respond to them.

Communication Preferences

You may unsubscribe from promotional email using the link in the message. You may opt out of marketing text messages by replying STOP. We may still send non-promotional communications, such as order, account, subscription, safety or legal notices. Consent to marketing text messages is not a condition of purchase.

Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, manage accounts and subscriptions, fulfill orders, maintain transaction and consent records, comply with tax and other legal obligations, resolve disputes, enforce agreements, prevent fraud and protect our rights. Retention periods vary based on the type and sensitivity of the information, the purpose of processing, legal requirements and whether the information is needed for an active relationship. We delete, deidentify or securely dispose of information when it is no longer required, subject to lawful backup and record-retention practices.

Security

We use reasonable administrative, technical and physical safeguards designed to protect personal information. No security measure or transmission method is completely secure, and we cannot guarantee absolute security. Do not send sensitive or confidential information through unsecured channels. You are responsible for protecting your account credentials and should notify us if you believe your account has been compromised.

Children’s Privacy

The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. Health-related quizzes and surveys are intended only for individuals age 18 or older. If you believe a child has provided personal information, contact us so we can review and delete it as required. We do not knowingly sell or share personal information of individuals under 16.

Third-Party Websites and Services

The Services may link to websites, social platforms or services operated by others. Their privacy and security practices are governed by their own notices. We are not responsible for third-party services we do not control. Information posted publicly or on social platforms may be visible and used by others.

Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices, technology, legal requirements or other operational reasons. We will post the revised Policy, update the effective date and provide additional notice when required by law.
